Please read these Terms carefully. They are a binding agreement between you and Learn My EV that governs your access to and use of our website, content, and services — and include an arbitration agreement and class-action waiver in Section 21.

1.Agreement to These Terms

These Terms & Conditions (the “Terms”) form a legally binding agreement between you (“you,” “user,” or “your”) and Learn My EV (“Learn My EV,” “LMEV,” “we,” “us,” or “our”) governing your access to and use of the website located at learnmyev.com and any related pages, content, newsletters, community features, and services we provide (collectively, the “Service”).

By accessing, browsing, subscribing to, creating an account on, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Service.

2.Definitions

For clarity, the following terms have the meanings below:

  • “Content” means all text, articles, guides, tutorials, checklists, reviews, images, graphics, video, data, software, and other materials made available on or through the Service.
  • “LMEV Content” means Content owned, created, licensed, or made available by Learn My EV.
  • “User Content” means any content you submit, post, or transmit through the Service, including community posts, comments, and messages.
  • “Intellectual Property Rights” means all copyrights, trademarks, trade dress, trade secrets, patents, database rights, and all other proprietary rights, worldwide.

3.Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement and consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements, that you have the legal capacity to enter into these Terms, and that all information you provide is accurate and current.

4.Accounts and Registration

Some features may require you to register for an account or provide an email address. You agree to provide accurate information, to keep it up to date, and to keep your credentials confidential. You are responsible for all activity that occurs under your account. You must notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts at our discretion, including for violations of these Terms.

5.What LMEV Provides — and What It Does Not

LMEV provides educational and informational content about electric vehicles, including news, guides, tutorials, checklists, and a community. All Content is provided for general informational and educational purposes only. It is not, and should not be relied upon as, professional, mechanical, safety, financial, legal, or manufacturer advice.

LMEV is an independent resource. We are not affiliated with, endorsed by, sponsored by, or otherwise officially connected to Tesla, Inc., Rivian, Ford, Lucid, Chevrolet, or any other vehicle manufacturer, charging network, or brand referenced on the Service. All product names, logos, and trademarks belong to their respective owners and are used for identification and descriptive purposes only. Always follow your vehicle manufacturer’s official documentation and consult a qualified professional before acting on any information found here.

6.Intellectual Property — Our Rights

The Service and all LMEV Content are the exclusive property of Learn My EV and its licensors and are protected by United States and international copyright, trademark, trade dress, trade secret, and other Intellectual Property Rights. This includes, without limitation:

  • all text, articles, guides, tutorials, checklists, reviews, and written Content;
  • the “Learn My EV,” “LMEV,” and “Town Square” names, logos, and branding;
  • the site design, layout, “look and feel,” graphics, icons, color schemes, and user interface;
  • the structure, selection, arrangement, and organization of our Content and features; and
  • all underlying concepts, methodologies, formats, compilations, and know-how embodied in the Service.

Except for the limited license granted in Section 7, nothing in these Terms transfers to you any right, title, or interest in or to any of the foregoing. All rights not expressly granted are reserved by Learn My EV.

7.Limited License to You

Subject to your full compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and view the Service for your own personal, non-commercial use. This license does not include any right to resell, repackage, redistribute, or commercially exploit the Service or any Content. We may revoke this license at any time.

8.Prohibited Conduct — No Copying of Our Content or Ideas

We have invested significant time, effort, and originality into LMEV. To protect that work, you agree that you will not, and will not permit or assist any third party to, do any of the following without our prior express written permission:

  • copy, reproduce, republish, scrape, mirror, frame, or store any portion of the Service or LMEV Content;
  • reproduce, imitate, or create derivative works based on our Content, design, layout, branding, checklists, or course/learning formats;
  • use our concepts, structure, organization, methodology, or “look and feel” to build, launch, or operate a competing or substantially similar website, product, newsletter, or service;
  • use any automated means (bots, crawlers, scrapers, or data-mining tools) to access or collect Content, including for the purpose of training machine-learning or artificial-intelligence models;
  • reverse engineer, decompile, or attempt to derive the source code or structure of any part of the Service;
  • remove, alter, or obscure any copyright, trademark, or other proprietary notice;
  • resell, sublicense, rent, lease, or otherwise commercially exploit the Service or any Content; or
  • use the Service for any unlawful purpose, to harass others, to transmit malware, or in any way that could damage, disable, overburden, or impair the Service or interfere with another user’s use of it.

The names, logos, layout, Content, and original ideas presented on LMEV are proprietary to us. You acknowledge that any unauthorized copying or imitation of our Content or concepts would cause irreparable harm for which monetary damages would be inadequate, and that we are therefore entitled to seek injunctive relief in addition to all other remedies available at law or in equity, without the need to post a bond.

9.Copyright Complaints (DMCA Policy)

We respect the Intellectual Property Rights of others and expect users to do the same. If you believe Content on the Service infringes your copyright, please send a written notice to our designated agent at info@learnmyev.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and its location on the Service; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf. We may remove allegedly infringing material and terminate repeat infringers in appropriate circumstances.

10.Feedback and Submissions

If you send us ideas, suggestions, or feedback about the Service (“Feedback”), you agree that we may use it freely, without restriction, attribution, compensation, or obligation to you, and that such Feedback is provided on a non-confidential and royalty-free basis. This protects LMEV from later claims that we “took” an idea a user volunteered.

11.User Content and the License You Grant Us

You retain ownership of any User Content you submit. However, by submitting User Content, you grant Learn My EV a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, host, store, reproduce, display, adapt, publish, and distribute that User Content in connection with operating and promoting the Service. You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe any third party’s rights or violate any law.

12.Community Conduct

Our community features (including the “Town Square” and any forums, comments, or social channels) are intended for respectful, constructive discussion among EV owners and enthusiasts. You are solely responsible for your User Content. You agree not to post anything that is unlawful, defamatory, harassing, hateful, infringing, deceptive, spam, or that you do not have the right to share. We may, but are not obligated to, monitor, remove, edit, or restrict any User Content or user at our sole discretion and without notice or liability.

13.Third-Party Links, Sources, and Editorial Content

The Service may contain links to third-party websites, products, or services that we do not own or control. We provide these links for convenience only and do not endorse and are not responsible for the content, accuracy, policies, or practices of any third party. Accessing third-party sites is at your own risk and subject to their terms.

Editorial sources and research. Our news articles, guides, and editorial content may incorporate facts, data, statistics, and information derived from publicly available third-party sources, including news publications, press releases, manufacturer announcements, regulatory filings, and research reports. We make reasonable efforts to credit sources within individual articles where practicable. Such references are for informational attribution only and do not imply endorsement, partnership, or affiliation with those sources.

Images and media. Some images and media displayed on the Service are sourced from third parties, including press and promotional materials made publicly available by manufacturers and news organizations. We credit image sources where known and do not claim ownership of third-party images. If you believe an image has been used without proper authorization, please contact us at info@learnmyev.com and we will promptly review and address your concern.

No endorsement. The inclusion of any third-party source, quote, statistic, or image does not constitute an endorsement of, or affiliation with, that source. LMEV does not guarantee the accuracy, completeness, or currency of information drawn from third-party sources and is not liable for any errors or omissions therein.

14.Newsletter, Waitlist, and Communications

When you join our waitlist or subscribe to our newsletter, you consent to receive emails from LMEV about updates, news, and offerings. You may unsubscribe at any time using the link in any email. How we handle your email and other personal information is described in our Privacy Policy.

15.Electronic Communications and Consent

By using the Service, you consent to receive communications from us electronically, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

16.Paid Offerings (Reserved for Future Use)

The Service is currently provided free of charge. We may in the future introduce paid Content, subscriptions, or learning packages. If and when we do, additional terms — including pricing, billing, renewal, and refund terms — will be presented to you and will form part of these Terms with respect to those paid offerings. Your continued use after such terms are posted constitutes acceptance of them.

17.Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, LEARN MY EV DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any Content is accurate, complete, current, or reliable. You use the Service and rely on its Content at your own risk.

18.Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LEARN MY EV AND ITS OWNERS, OPERATORS, CONTRIBUTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR RELIANCE ON ANY CONTENT — INCLUDING ANY DAMAGE TO A VEHICLE OR PROPERTY — WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100.00) OR THE AMOUNT YOU PAID US IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

19.Indemnification

You agree to defend, indemnify, and hold harmless Learn My EV and its owners, operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or related to your use of the Service, your User Content, your violation of these Terms, your violation of any law, or your infringement of any third party’s rights.

20.Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, the license granted to you ends immediately. All provisions that by their nature should survive termination — including Sections 6–11 (intellectual property, prohibited conduct, feedback, and user-content license), 17–19 (disclaimers, liability, indemnification), and 21–25 (dispute resolution and general terms) — will survive.

21.Binding Arbitration and Class-Action Waiver

Please read this section carefully — it affects your legal rights. You and Learn My EV agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (“Dispute”) will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for actual or threatened infringement or misuse of Intellectual Property Rights (consistent with Section 8).

Informal resolution first. Before starting an arbitration, you agree to contact us at info@learnmyev.com and attempt to resolve the Dispute informally for at least thirty (30) days.

Arbitration procedure. The arbitration will be administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable consumer rules, and governed by the Federal Arbitration Act. The arbitration will take place in or near Oklahoma County, Oklahoma, or be conducted by video or telephone where permitted. The arbitrator has exclusive authority to resolve disputes about the interpretation or enforceability of this arbitration agreement.

Class-action waiver. You and Learn My EV agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class proceeding.

Opt-out. You may opt out of this arbitration agreement by emailing us within thirty (30) days of first accepting these Terms, stating your name and that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.

22.Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Oklahoma and the federal laws of the United States applicable therein, without regard to conflict-of-laws principles. Subject to the arbitration agreement in Section 21, you agree that the state and federal courts located in Oklahoma County, Oklahoma will have exclusive jurisdiction over any Dispute that is permitted to proceed in court, and you consent to personal jurisdiction and venue there.

23.Force Majeure

Learn My EV will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, governmental action, power or internet failures, hosting or third-party service outages, or cyberattacks.

24.Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

25.Assignment, Severability, and Miscellaneous

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent; any attempted assignment in violation of this section is void. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets. If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of it. Headings are for convenience only and do not affect interpretation.

26.Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented for specific features or paid offerings, constitute the entire agreement between you and Learn My EV regarding the Service and supersede all prior or contemporaneous understandings.
